Final Ruling to "Duration of Status" in the U.S. for F Visa Holders

On July 17, 2026, the Department of Homeland Security (“DHS”) published a final ruling to change the I-94 admission date to an exact date in which an individual can be in the U.S. lawfully for F nonimmigrant students and scholars. This rule takes effect on September 15, 2026, 60 days after publication in the Federal Register.

This rule has been classified as a major rule subject to congressional rule, which may change the effective date, or the rule itself. International Student Services (“ISS”) will update this page as more information becomes available.

What is changing?

Currently, F-1 students and scholars are admitted to the United States for “Duration of Status,” meaning they may remain in the U.S. as long as they maintain valid status. Under the new rule, F-1 students will instead be admitted until a fixed date tied to their program end date, not to exceed four years.

This change may affect students who need additional time to complete their program, apply for OPT, transfer schools, change academic programs, change academic levels, or begin a new program.

Other Key Changes

In addition to the ending of the Duration of Status, there are other key implications in the final ruling to be aware of:

  • F students enrolled in ESL or undergraduate programs cannot change their major during their first year of study.
  • Undergraduate and ESL students cannot transfer schools their first year of study.
  • Students who need additional time to complete their degree may apply for an Extension of Stay through USCIS.
  • The post-completion grace period for F-1 is reduced from 60 days to 30 days.
  • The rule includes a temporary 6-month transition period for some students applying for OPT.

What about current students?

Many students who were admitted for Duration of Status and are properly maintaining F-1 status in the United States on September 15, 2026, will receive transitional protection and will not need to take immediate action solely because the rule takes effect. However, travel outside the United States and readmission after September 15 may place a student under the new fixed-period admission rules. Students should consult ISS before international travel or making changes to their academic plans.
